Our "Members" include property estate agents, letting agents, landlords, property developers, international property owners, and other companies which provide property services. My Casa Away is not an Estate Agency.

"Partners" are selected companies whom we choose to work with to offer complimentary Services such as finance brokers, mortgage advisors, currency exchange, utilities and broadband.

"Services" or “Service” include property advertising, valuation, software solutions, websites, email marketing, digital marketing, video editing and property matching tools.

We provide the My Casa Away property portal so that:

  • Members to advertise property details online for You;
  • We, or Our Members, can provide estate agent services, insurance, tenant and financial services to You;
  • References to "Users", "You", “Yourself” or "Your" is a reference to individuals using Our Portal or Services.

References to "Personal Information" means information that will allow Us to identify You and is set out in more detail in the "Personal Information We Collect" sections below.

We may from time to time change the content of this privacy policy, Website or suspend or discontinue any aspect of this Site, which may include your access to it.

Introduction

We are committed to protecting Your privacy. This privacy policy explains how and for what purposes We use the Personal Information collected about You when You use the Site or download and use Our App on Your mobile devices.

Our Portal is not intended for anyone under the age of 18. We do not knowingly collect or process Personal Information relating to Children. Property advertised on the website

What We collect and where it comes from

  • In order to provide Our Services, We collect property data such as images and videos of properties, virtual tours, property prices, sales history and sold prices, property addresses, floorplans, property features, property locations and property descriptions; vendors names, estate agents names, commissions and
  • The property data is provided to Us by Our Members or other third parties on behalf of those Members.

Why we collect this

  • We have a legitimate interest to process this Personal Information.
  • Providing a Service to Our Members by helping them to market and advertise properties and understand changing market trends;
  • Providing a Service to Our Members by advertising properties to potential purchasers or tenants;
  • Providing a Service to potential purchasers and tenants.

How long will we keep this data for?

We will stop advertising a property when We are instructed to do so by Our Members. However, some property information will remain available on the Portal as historical property information to allow Users and Our Members to benefit from Services such as identifying previous sold prices

Personal information you may give us

We will collect the Personal Information that You give to Us when using Our Portal or Services:

Enquiries to Our Members

If You so choose to access a specific search feature, request information or fill in a form on the Portal, Website, Account or Software, You may be asked to provide Personal Information about Yourself, for example:

  • Your name, address and contact details;
  • Details of the sort of property You are interested in;
  • The cost and location of the property;
  • Your current residential address;
  • What stage in the home moving process You are;
  • Whether You are a first time buyer, a seller, a landlord, a tenant, investor etc.;
  • Whether You are re-mortgaging
  • Whether You have a property to sell or let.
  • When enquiring about properties, We may also ask for:
  • Reason for buying
  • Your country of residence
  • Whether You require assistance and advice from Our Currency Exchange, Finance, Mortgage, Insurance partners, or other Partners
  • When enquiring about rental properties, the following information may be requested
  • If You have any pets
  • If You consent to the agent performing a credit check and date of birth
  • If there will be smokers living in the property
  • Your employment status
  • Your desired tenancy requirements
  • If You choose to book an appointment to view a property via the Portal, You may be asked to provide more details, including:
  • Your availability to view the property;
  • Details of Your household income
  • Whether You have any adverse credit history that could affect Your application;
  • Your mobile number for the purpose of providing You updates via text regarding Your property viewing (includes sending reminders about Your booked viewings); and
  • If You choose to contact a Member using any contact details provided, calls may be recorded for training and monitoring purposes. We may also keep a record of call activity, including missed calls.

How long will you keep this

  • We will retain Your Personal Information for as long as required to fulfil the purposes We collected it for, including any service, legal, accounting, or reporting purpose.
  • We will retain this personal data for up to 5 years, after which it will be deleted or anonymised;

Registered Users and Property Alerts:

Personal Information that You provide to Us when You Register as a My Casa Away User;

  • Request property email updates such as Property Alerts about when a property is marketed in Your chosen locations and meeting Your search parameters;
  • Send enquiry information and information about your property requirements to our Members;
  • Book property viewings and appointments via Our Website & Service;
  • Save a property;
  • Request property viewings and appointments via Our Site
  • Whether You own the property, are a tenant of the property, or are looking to the buy the property; and
  • Adding saved properties, property details and notes.
  • We may also ask what stage in the home moving process You are, whether You are a first time buyer, a seller, tenant, a landlord, investor, whether You are re-mortgaging etc.
  • We share this information with our Members to provide Services to Users and Members

Why we collect this

To make sure that You receive the benefit of the Service.
This may include

  • Transfer of Your property enquiry and property requirements to Our Members so that they can respond to Your enquiry. Some of Our Members may use:
  • Lead handling agencies who handle and process Your enquiry on their behalf; or
  • Third party software, systems, website to process and store Your enquiry to allow them to respond to and manage Your enquiry;
  • Sending Your request to book a property viewing to Our Member who is advertising that property and for Us to confirm Your booking by email or text on Our Member’s behalf;
  • Sending Your name, address and contact details to a Member, when You request information, property lists, or a brochure on a property, so that a Member may contact You;
  • Where You book an appointment with a member or to view a property, We may create a calendar appointment in Our Members email system (via calendar software) in order to manage Your booking;
  • Our Members must form their own legal basis for processing Your enquiry data if they are processing it for purposes other than responding to Your initial enquiry;
  • When enquiring about properties, We will also share:
  • Whether You have expressed interest in receiving advice about Currency Exchange, Finance, Mortgages, insurance.
  • When enquiring about rental properties, additional information will be requested to enable the agent to better understand Your circumstances and suitability for the property.
  • To enhance the service you receive from Our Members.
  • To provide You with the benefit of Services for registered Users only;
  • To provide Property Alerts to You (which You have set up) for properties marketed on Our Portal that meet Your search criteria;
  • To provide You access to Your enquires, favorite properties and saved searches.
  • To keep you updated on Your account and Services available to You; and
  • To provide You tailored content including suggesting properties or Services relevant to You.

How long will we keep this

  • We will retain Your Personal Information for as long as required to fulfil the purposes We collected it for, including any service, legal, accounting, or reporting purpose.
  • We will retain this personal data for up to 5 years, after which it will be deleted or anonymised;

Financial Information (Mortgages & Funding Requirements)

My Casa Away are not Lenders or Finance Advisors. Our Members include Finance professionals.

In the course of providing Our Services We collect Personal Information about your Mortgage requirements. This includes

  • Contact and identity data: Full names (including any previous known names), date of birth, gender, country of birth and nationality;
  • Applicant data: Number of people applying;
  • Employment data: Employment status, job title, job role, industry, contract type, length of employment, self employed details or job details.
  • Financial data: Mortgages held, details about how You would like to finance Your property purchase, property price/value, deposit details (amount and source of money), mortgage term, credit cards, loans, or debts.
  • Personal Property data: Your property ownership information.
  • Lifestyle data
  • Your consent to share special category data with Finance Members
  • Finance Members will provide You information on Your mortgage and finance options.
  • We also collect data as detailed above in the "Personal Information We collect about You"

Why we collect this

  • Provide You with information You requested about mortgages that help with property purchases

How long will we keep this

  • We will retain Your Personal Information for as long as required to fulfil the purposes We collected it for, including any service, legal, accounting, or reporting purpose.

Sharing personal information between My Casa Away, its subsidiaries and members

Personal Information You provide Us may be shared between Our subsidiaries and members in order to:

  • Provide Our Website and Services to You;
  • Improve Our Portal, Software and Services; and
  • Customise Your experience on Our Website

Use of your Personal information for direct marketing and other communication types

Direct Marketing

Sometimes We may Use Your Personal Information to provide direct marketing messages to You; either directly from Us or on behalf of Our Members. You can opt out of direct marketing at any time from Our entities below by

User and Member Profiling

  • We may from time to time profile Your activity when using Our Services, Website or engaging with our Ads.
  • This profiling is based on contact information, telephone and email enquiries You send to Our Website, Social Media Pages, Messages, Emails, Members, properties advertised on Our Platforms, cookies and information You either provide Us or We collect in the course of using Our Website, engaging with our ad campaigns and Services. We may use this information both now and, in the future, to identify:
  • Understand what properties You may be interested in;
  • Understand your property requirements
  • Identify training opportunities;
  • Match enquiries sent to Our Members with properties advertised on Our Websites.
  • Your activity to help Us and Our Members determine how likely You are to require services from Our Members. Members may then contact You to offer their services, although they can only do so if they have a lawful reason to do so (known as a lawful basis of processing Your Personal Information);
  • Suggest properties that may be of interest to You;
  • Suggest Members who can offer Mortgage, Finance, Insurance, Area Information, Valuations and Property lists.
  • Suggesting services from Our third party advertisers that may be relevant and of interest to You based on Your use of Our Website.

How long will we keep this

  • We will retain Your Personal Information for as long as required to fulfil the purposes We collected it for, including any service, legal, accounting, or reporting purpose.

  • Receiving Property Alerts where You have set them up in Your My Casa Away account (You can amend your Property Alerts at any time in Your My Casa Away account);

Who has access to Your personal data?

We retain access to all Personal Information that We have collected from You or about You.

Once Your Personal Information has been passed to one of Our Members during the process of providing Our Services (for example when You communicate with an estate agent through Our Website) then Our Member will have a copy of the Personal Information that You have provided.

Property data, it is provided to Us by Our Members (or third parties that act on their behalf).

Our Members are responsible for Personal Information in their possession.

My Casa Away are not responsible for use (or misuse) of Your Personal Information by any of Our Members.

We may also have links to other third party websites, portals, software, services. Clicking on those links or enabling those connections may allow third parties to collect or share Personal Information about You.

We recommend that You check the policy of each website that You visit to ensure you are happy with the way they use Your data.

If We offer or faciliate a Service to You that is provided on Our behalf by a third party, We may have to share Your Personal Information to them in order to deliver the service. The categories of third parties (who are acting as Data Processors which means they are responsible for processing Personal Information on behalf of Us) include:

  • Telephony providers (including call recording);
  • Our support ticketing systems;
  • Our CRM & Email Services;
  • SMS providers;
  • Online calendar providers;
  • E-signatory providers;
  • Payment providers;
  • Translation and transcription providers;

Where do we store your data?

Like many websites, software and App providers, My Casa Away utilise "cookies" to enable Us to personalise Your visits to Our Websites, simplify the Login process, and keep track of Your preferences.
